Welcome to Charlie Jones Illustration. These Terms of Service ("Terms") apply to your use of our website and online store and to any purchases you make from us.

By using our website or placing an order, you agree to these Terms, together with our Privacy Policy and Return & Refund Policy.

These Terms apply to customers purchasing from us internationally, subject to the applicable consumer protections in their country of residence.

We currently sell and deliver to customers in the United Kingdom and selected international destinations. Available destinations and delivery options are shown at checkout.

2. Our Products

We make every reasonable effort to ensure that product descriptions, images and colours shown on our website are accurate.

Please note that colours may appear slightly different depending on your device, monitor and display settings.

Our prints are artworks, and minor variations in colour or appearance may occur between the image shown on screen and the physical printed product.

We reserve the right to update product descriptions, discontinue products and limit quantities where reasonably necessary.

Nothing in these Terms affects your statutory rights as a consumer.

3. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place an order, you will receive an order confirmation by email confirming that we have received your order. This does not necessarily mean that your order has been accepted.

Your order will be accepted when we confirm that the order has been accepted and/or when we dispatch the products to you.

We reserve the right to cancel an order where, for example:

• The product is unavailable;

• There has been an obvious pricing or product description error;

• We reasonably suspect fraudulent or unauthorised activity; or

• We are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will provide a full refund of the amount paid for the cancelled order.

4. Prices and Payment

All prices displayed on our website are in pounds sterling (£).

The price you pay will be the price displayed at the time you place your order, unless there has been an obvious pricing error.

Delivery charges will be shown separately before you complete your purchase.

Payment must be made at the time you place your order using one of the payment methods available at checkout.

We use Shopify and third-party payment providers to process payments. We do not store your full payment card details.

5. Delivery

We currently deliver to the United Kingdom and selected international destinations.

Available delivery options, destinations and their costs will be shown at checkout before you place your order.

We will aim to dispatch orders within the timeframe stated on the relevant product or checkout page.

Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including carrier delays or other unforeseen events.

If your order does not arrive within the expected timeframe, please contact us and we will do our best to assist you.

International orders may be subject to customs duties, import taxes or other charges imposed by the destination country. Unless otherwise stated at checkout, these charges are the responsibility of the customer.

Nothing in these Terms limits your statutory rights regarding delivery.

6. Returns, Cancellations and Refunds

Your statutory cancellation and consumer rights are explained in more detail in our Return & Refund Policy.

For standard, non-personalised products purchased online, you generally have the right to cancel your order within 14 days of receiving it without giving a reason, followed by a further 14 days to return the goods, where applicable under the laws that apply to your purchase.

For change-of-mind returns, you are generally responsible for the cost of returning the item to us.

Where you exercise your statutory right to cancel, we will refund the applicable standard delivery charge paid for the original order, where required by applicable law.

Personalised or custom-made products may be excluded from the statutory cancellation right where an applicable legal exception applies.

Nothing in these Terms or our Return & Refund Policy affects your statutory rights.

7. Faulty, Damaged or Incorrect Products

We are responsible for ensuring that the products we sell are as described, of satisfactory quality and fit for purpose where required by law.

If your print arrives damaged, faulty, defective or you receive the wrong item, please contact us at charlie.bbjones@gmail.com as soon as possible.

Please provide your order number and, where possible, photographs of the product and packaging so that we can assess the issue.

We will provide an appropriate remedy in accordance with your statutory rights.

8. Personalised and Custom Products

If we offer personalised or custom-made products, these will be produced specifically according to your requirements.

You are responsible for checking that any information you provide for a personalised or custom order is accurate.

Where permitted by law, personalised or custom-made products may not be eligible for cancellation simply because you have changed your mind.

This does not affect your statutory rights if the product is faulty, damaged, incorrectly made or otherwise does not conform to the contract.

9. Intellectual Property

All artwork, illustrations, photographs, designs, logos, text and other content appearing on our website are owned by or licensed to Charlie Jones Illustration unless otherwise stated.

You may view and use our website for your personal, non-commercial purposes.

You must not reproduce, copy, modify, distribute, sell, publish or commercially exploit our artwork, illustrations, photographs, designs or other website content without our prior written permission.

Purchasing a print does not transfer ownership of the underlying copyright or intellectual property rights in the artwork to you.

You are purchasing the physical print only, unless we expressly agree otherwise in writing.

10. Customer Reviews and Feedback

If you choose to submit a review, comment, photograph, testimonial or other feedback about our products or Services, you must ensure that you have the right to provide that content and that it does not infringe another person's rights.

By submitting content to us, you give us permission to use it for the purpose of operating and promoting our business, including displaying customer reviews on our website and social media, where appropriate.

We will not claim ownership of your original content simply because you submit it to us.

We may remove content that is unlawful, misleading, abusive, offensive or otherwise inappropriate.

11. Website Use

You agree to use our website only for lawful purposes.

Our online store is powered by Shopify.

Shopify provides the ecommerce platform that enables us to sell our products and process customer orders.

However, purchases made through our store are transactions between you and Charlie Jones Illustration. Shopify is not the seller of our products and is not responsible for the products we sell or our obligations to you.

14. Website Availability

We aim to keep our website available and functioning correctly, but we cannot guarantee that it will always be available, uninterrupted or completely error-free.

We may temporarily suspend or restrict access to the website for maintenance, updates, security reasons or circumstances outside our reasonable control.

15. Our Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence;

• Fraud or fraudulent misrepresentation;

• Breach of your statutory consumer rights;

Subject to the above, we are not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as natural disasters, serious disruptions to transport services, strikes, government action, widespread technical failures or other events that we could not reasonably have prevented.

Where such an event affects your order, we will take reasonable steps to keep you informed and minimise the impact.
